  1. What is role of the compliance department?

    With the aid of a compliance process, the department’s role is to ensure that education providers adhere to the KHDA regulations and guidelines.

  2. What is a compliance process?

    A compliance process will enable KHDA to implement policy, legislative and regulatory requirements that need to be met by educational provider in Emirate of Dubai; thereby managing and monitoring the effectiveness of educational provision. The system’s components ensure that the education providers are adhering to KHDA’s regulations.

  3. What are the components of the compliance process?

    The main components of the process include governance, compliance methodology, reporting, validation and resultant action plans.

    Governance: This includes the laws, regulations on the federal, local and KHDA level and includes but is not limited to a code of conduct due to be spelled out in KHDA’s compliance process.

    Compliance Methodology: This is the process of checking to verify if complaints received are actually incidents of non-adherence.

    Reporting: This refers to the reporting mechanism that includes evidence-based findings that either prove or refute the incidents of non-adherence.

    Validation: This is a process whereby all reports are verified and validated by other members of the team that were not part of the compliance visits.

    Resultant action plans: Education providers are usually required to provide a corrective action plan from the respective departments that will set right the non-adherence. In most cases the plans are also required to remove the root cause of the non-adherence.

    The compliance process ensures that the regulations are followed and the permit system is working effectively. The continuous validity of the system is ascertained from time to time in a scientific manner to deliver the desired results and outcomes, thus ensuring consistent adherence to education standards.

  5. Is adherence to the compliance process compulsory?

    Adherence to the compliance process is a mandatory requirement for all education providers.

  6. What is the role of the compliance controllers?

    The compliance controllers are authorized to enter and audit the premises of an education provider at any time for all reasons that are set out in the compliance request. If required and deemed necessary, the Controllers are permitted to conduct the visit incognito and anonymously. The report submitted by them inevitably has evidence that either proves or refutes the incidents of non-adherence to the KHDA regulations and guidelines.

  7. What incentives are provided to education providers that comply with KHDA regulations?

    Education providers that exhibit regular and fully compliance with KHDA’s regulations are awarded non-monetary incentives in line with the situation and need at the school. A couple of these are listed here for illustrative purposes:

    - Holding KHDA’s board meetings in the school.
    - Free review of business plans in case of branch and new openings.
    - Fast track card for quick services in KHDA.
    - Promotion through KHDA website.
    - Land rent freeze if the school has leased land from Dubai Real Estate Corporation.
    - Recognition at public events.
    - Increased engagement and involvement by KHDA.

  8. What are the consequences of continuous and repeated non-adherence of regulations?

    Educational providers that exhibit repeated non-adherence to KHDA’s regulations run the risk of non-monetary punitive measures being imposed on them, including (in extreme cases) the non-renewal of their Educational Services Permit.
