What is the Dubai Private Schools Resolution?
The Executive Council Resolution No (2) of 2017, signed by Crown Prince of Dubai and Chairman of Dubai Executive Council His Highness Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, establishes the legal framework to improve and strengthen the private schools sector in the interests of parents, school operators and investors in Dubai.

It was enacted to further enhance access to high quality education in Dubai, provide assurance to the community and continue to support good practices by providing greater transparency, in line with Dubai’s strategic plans.

What does this Resolution affect?
This Resolution is like the ‘playbook’ for private schools in Dubai. It includes details on the rules and guidelines schools must follow to open and operate in Dubai. Its objectives include:

  • Regulating private education in schools
  • Improving the quality of education by enhancing learning environment in schools
  • Creating a world-class private schools sector that brings out the best from within
  • Encouraging investment in the private school sector.
  • Applying global best practices in schools
  • Linking educational outcomes with Dubai’s strategic goals.

What is the scope of this Resolution?
The Resolution applies to all private schools in Dubai, including those in free zones and the Dubai International Financial Centre (DIFC). It does not include nurseries or universities.

Who is this Resolution for?
This Resolution is for parents, teachers, school leaders, operators and investors, for the benefit of students in Dubai. It supports positive practices in Dubai’s schools by providing clear guidelines and expectations.

Does the Resolution affect fees?
Tuition fees paid by parents are regulated by the School Fees Framework and will not be affected by this Resolution. Licensing fees paid by schools will be charged.

Who is responsible for implementing the Resolution?
The Resolution gives KHDA full responsibility for implementing its terms and conditions.

Why was this Resolution enacted?
This Resolution was enacted to further enhance access to high quality education in Dubai, provide assurance to the community and continue to support good practices by providing greater transparency, in line with Dubai’s strategic plans.

How will this law encourage investment in private education?
The Resolution provides investors with an open and transparent framework for how private schools in Dubai are regulated. It clearly sets out KHDA requirements for opening and maintaining a school, as well as offering details on associated costs.

What are some of the articles covered in the Resolution?
The Resolution includes articles on health and safety, quality of education, licensing, school facilities, faculty, fees and costs, to name a few. It also details the approvals required for licensing, changes to leadership or curriculum and tuition fees, among others. Further terms include teacher recruitment, policies on admitting and supporting children with special education needs, and ongoing professional development for faculty and staff.

What are the cost implications of the Resolution?
The Resolution includes details on annual licensing fees which have previously not been charged. Not-for-profit schools pay a smaller fee than for-profit schools. It also gives KHDA authority to levy fines for specific cases of non-compliance, the rates of which are fully set out in the Resolution.

How will this Resolution impact my school?
The majority of schools in Dubai will see little to no impact, as they are already in compliance with the terms of the Resolution. Schools which are not in line will have one year from the date of publication of the Resolution to comply with its terms.

When will the Resolution be available in English?

An official English translation of the law is forthcoming from the Executive Council.

Why was this Resolution put in place?
This Resolution was enacted to improve the quality of schooling in Dubai and to support the good practices being implemented by Dubai’s private schools.

What does it mean for me?
The Resolution is like a ‘playbook’ for opening and operating a private school in Dubai. The Resolution benefits parents by outlining schools’ responsibilities to children. For example, the Resolution gives parents assurance that their children’s teachers have tertiary-level qualifications, that health and safety guidelines are followed, that school facilities will cater for student with special education needs and that no student will be discriminated against on the basis of their race, nationality or gender.

Does this Resolution affect my child’s school?
The majority of schools already comply with the terms of this Resolution by providing high-quality education to a wide range of students, delivered by qualified teachers in a safe and healthy environment. Schools which do not currently comply with the terms of the Resolution will have one year to do so.

Will the Resolution affect tuition fees?
No. Tuition fees are regulated by the School Fees Framework and will not be affected by this Resolution.
